BEEBE, Ark. (KTHV) -- Battery charges are upgraded to a manslaughter charge for a Beebe man arrested in the shooting death of a 7-year-old.

According to an affidavit, 26-year-old Jeremiah Owens was at a friend’s house on February 27. He was looking at his friends new handgun.

Owens said he didn't know the gun was loaded when it went off in his lap, hitting the loveseat next to him where the 7-year-old girl was sitting. The 7-year-old was hit in the head.

She had a single gunshot wound near her right eye. March 1 she was pronounced brain dead. She was removed from the ventilator and died on March 4.

Owens is due in court for the new manslaughter charge, a Class C Felony, on May 2.
