LITTLE ROCK, Ark. (KTHV) -- The U.S District Court for the Western District of Arkansas has denied Don Davis' motion for a stay of his execution.
The stay was denied by U.S. District Judge Susan Hickey because "Davis did not seek the instant relief within a reasonable time and has not presented extraordinary circumstances to warrant relief".
Davis was convicted of murdering 62-year-old Jane Daniel in her home in Rogers in 1990.
Davis' execution is scheduled for Monday. If Bruce Ward's case remains on hold but the others go forward, Davis would be the first man up for execution.
