LITTLE ROCK, Ark. (KTHV) - A man charged with battery is now being charged with murder after the victim dies from his injuries.

Thomas Daniel Trosper, 43, is in police custody and initially charged with first degree battery after a July 30 incident.

Police were called to a house on Brown about an assault. When they got there they found Donald Ray Jenkins, a homeless man, lying on the sidewalk. Police say his left eye was swollen, his lip was busted, and the back of his head was bleeding. When police talked to him, he didn't remember his name or what happened to him.

Jenkins was taken off life support Aug. 8 and he died as a result of his injuries. Trosper's charges have been upgraded to first degree murder.
