    Attorney Joe Don Winningham for county administrator fined for motion

    CONWAY, Ark. (AP) - The attorney for a Faulkner County official charged with theft has been fined for a motion to dismiss that case.

    Circuit Judge Rhonda Wood fined attorney Joe Don Winningham $5,000 Wednesday for what she called an improper and frivolous motion.

    Winningham's motion said Wood was out of her jurisdiction when she signed a felony arrest warrant against county administrator Jeff Johnston. Winningham says Wood is a juvenile judge not allowed to preside over the case.

    Wood said judges within the same division have the same power to sign warrants.

    The judge said she'll void the sanctions if Winningham drops the motion within three weeks. Winningham said he is not likely to do that.

    Johnston has pleaded not guilty to using county money to pay for work on his driveway.
