LOGANSPORT, IN (CBS/WLFI) -- The family of a missing Kokomo woman finds out today if a judge will accept a plea deal offered to the man accused of her murder. It's a deal the family opposes.
It's been more than a year since 27-year-old Kelly Armstrong was reported missing in Kokomo in September 2011.
Even though her body has never been found, Armstrong's boyfriend, Travis Funke was arrested for her murder about four months later in January 2012. Now, the Armstrong family says the prosecution is offering him a plea deal.
The family says it's a deal that initially blindsided them. Armstrong's cousin Charity Grable says, "This was a whammy to the family. They didn't get any notification." Armstrong's father David says, "The prosecution has never sat down with us to discuss any parts of the plea agreement. Why the plea agreement should be filed, he's never given us a copy of it to view."
David and Charity say what they do know about the plea agreement is this: Funke can plead guilty to voluntary manslaughter and get a 50 year sentence with 35 years in prison with 15 years suspended. In return, Funke must say where Armstrong's body is located. Armstrong says, "If Travis was cooperating with the police and being honest I would have buried my daughter a long time ago."
According to Howard County court documents, Funke confessed to killing Armstrong with a hammer and disposing of her body in a trash tote. Police searched the landfill, but did not find a body.
The Armstrong family says if Funke's information led to Armstrong's body they would feel different about the plea deal. Grable says, "If she is in a landfill like he stated, yes, but if she is not in the landfill, absolutely not. He lied. He lied under oath. So no, no plea deal." Armstrong says, "I'm open for other avenues. As of right now if I don't have Kelly by tomorrow, no it's not going to happen."
Funke's plea deal hearing is Tuesday morning. Armstrong's family will be there as they have been since the beginning of the case.
Calls to Howard County Prosecutor Mark McCann were not returned.
