U.S. District Judge Bill Wilson issued the order Tuesday rejecting SWEPCO's motion. He ordered SWEPCO to meet with the Sierra Club and the U.S. Army Corps of Engineers on June 22 to discuss the case.
The Sierra Club and the Audubon Society sued in February, arguing that the Corps didn't go through the proper permitting process when allowing SWEPCO to build the plant in Hempstead County.
SWEPCO had asked the federal judge to dismiss the suit because the Sierra Club and Audubon Society didn't have proper legal standing. Wilson rejected that argument.
