CLARKSVILLE, Ark. (KTHV) -- A judge has declared a mistrial once again in the second trial of Gary Dunn. Prosecutors say they will try the case again - for third time.
Earlier, the jury met with the judge just before 6 p.m. They were split 9 to 3. We don't know how the votes fell.
Dirksmeyer was found dead in her apartment in Russellville. Her boyfriend at the time, Kevin Jones was arrested but acquitted of her murder in 2007.
This is the second trial for Gary Dunn, the first ended in a hung jury.
Dunn will continue to be held in the Pope County Jail. There is a gag order in place by the judge for this trial.
