CONWAY, Ark. (AP) - A hearing in Faulkner County on a motion to dismiss murder charges against a former emergency room doctor has been postponed.
Prosecutor Cody Hiland told the Arkansas Democrat-Gazette that Friday's hearing for Richard Conte was postponed until April 13rd because the prosecutor working the case had a conflict.
Conte was charged in August with the 2002 shooting deaths of Carter Elliott and Timothy Robertson at Elliott's home in Conway. He has pleaded not guilty.
The charges were filed two days before Conte was to be released from a Nevada prison where he served nine years for kidnapping his ex-wife.
Defense attorney Jack Lassiter argues that Hiland's predecessors reviewed the case and declined to charge Conte.
