MELBOURNE, Ark. (KTHV) -- A country singer is in an Arkansas juvenile court this morning over the issue of custody of her son.

Mindy McCready was found in a summer home in Heber Springs over the weekend with her son who she does not have custody.

Arkansas authorities say McCready did not have permission to be in the unoccupied summer home and the Arkansas Department of Human Services took into custody.

A Florida judge has ordered the boy to be returned to that state. McCready's mother is the boy's legal guardian.

Cleburne County Sheriff Marty Moss said authorities located McCready after receiving a report of quote-- "possible occupants in a summer home that was supposed to be unoccupied."

Authorities continue to investigate the matter.
