Arkansas marijuana cultivator received license with 'flawed' application

An Arkansas medical marijuana cultivator is at risk of losing his license after a judge ruled that he received it with a "fatally flawed application."

LITTLE ROCK, Ark. — An Arkansas medical marijuana cultivator is at risk of losing his license after a judge ruled in favor of the state's Alcoholic Beverage Control (ABC) Division revoking the license.

According to Arkansas Business, the license, which was given, to River Valley Relief owner Storm Nolan, was the last license handed out by the state's Medical Marijuana Commission (MMC). 

Nolan received the cultivation license in association to a business that he had "dissolved" prior to gaining possession of the license. 

This technicality is what prompted an Arkansas judge to rule in favor of the Arkansas Beverage Control Division to revoke Nolan's license, on basis of a "fatally flawed application." 

"The ABC and the MMC are taking the necessary steps to revoke the cultivation license at issue,” Kate Donoven, senior assistant attorney general, wrote to the Arkansas judge. 

The judge's decision comes after Southern Roots Cultivation was denied the license that Nolan received, despite Southern Roots feeling that it "should have rightfully won the license," according to Arkansas Business.  

With the revoking of Nolan's license in the air, the state's Medical Marijuana Commission will meet on Thursday to address the issue. 

This potentially vacant license is believed to be worth millions. This case has heightened visibility as well with the state currently voting on Issue 4, recreational marijuana. 

If this issue is passed, that same license would likely "multiply" in value according to Arkansas Business.
