Suspect with ‘AR-style rifle’ shot by Boone County Sheriff's Deputy

Arkansas State Police are investigating an incident where a Boone County Sheriff's Deputy shot someone during the early morning hours of December 31.

BOONE COUNTY, ARKANSAS, Ark. — At the request of the Boone County Sheriff's Office (BCSO), officers with Arkansas State Police (ASP) are now investigating an incident where an officer shot someone in Bellefonte during the early morning hours of December 31.

According to reports, just before 1:00 a.m. on Sunday, officers with the Flippin Police Department responded to a "suspicious vehicle call." Once they arrived, they found 20-year-old Spridal P. Hubiak (Spiral) of Waterville, Maine, asleep inside his car.

Police identified Hubiak as someone who was wanted in Maine for a homicide that happened just three days before. Officers attempted to arrest Mr. Hubiak but he left the scene.

During their pursuit, both ASP and Harrison Police used spike strips to try and stop Hubiak's vehicle as he drove near the intersection of Highway 62 and Highway 65. He later turned into a gas station parking lot where he crashed his vehicle and according to witnesses, proceeded to get out of the car allegedly holding an "AR-style rifle."

A sheriff with the BSCO then allegedly fired at Hubiak, striking him several times. Hubiak was then given medical aid by officers at the scene and was then taken to the hospital. 

There is no information regarding Mr. Hubiak's condition but reports state that he is expected to survive and is in the custody of the Greene County (Missouri) Sheriff's Office while he is hospitalized.

The names of the officer or officers involved have not been released at this time but we will update once we know more. 

No officers were injured during the incident and an investigative file will be shown to the prosecuting attorney to determine whether or not the use of deadly force by the officer was consistent with the law in Arkansas. 

The investigation into this incident remains ongoing and we will update with more information once it becomes available.
