PULASKI COUNTY, ARKANSAS, Ark. — After alleged repeated burning in a neighbor's yard, a Faulkner County viewer asked if there was anything they could do, writing, "the smoke has infiltrated my house, causing me to have a migraine and congestion, and the kids can't even go outside because our yard is filled with smoke."
If you take a look at the Arkansas Department of Environmental Quality's policy on burning yard waste – you'll find while open burning of yard waste is discouraged, no citation or civil fine should be issued against the owner of a private residence for open burning unless it becomes a persistent or recurring offense to surrounding landowners, as determined by complaints to state or local officials; a fire hazard to surrounding property; or a safety hazard causing obscured vision on public roads or highways.
We also found in Faulkner County Ordinance 06-22.
It gives the county the authority to regulate unsanitary conditions that may cause serious irreversible illness or pose a potential hazard to human health or the environment when improperly disposed of.
We reached out to the Faulkner County Sheriff's Office.
They told us if you ever have any issues regarding burning, you can contact their non-emergency number to file a complaint and they'll have a code enforcement deputy investigate.
